5 Ways You Can Hurt Your Personal Injury Case

Mia Little

If you have been injured at the fault of another, then you are likely going to want to follow through with a personal injury claim made against them. This will ensure that your medical bills and other expenses that came with the injury are fully covered. However, if you are going through with a personal injury claim, there are a few things that you could possibly do to damage your chances of winning. Here are five ways you can hurt your case:

  1. Not Seeking Immediate Medical Attention: After being in an accident, you will want to visit your doctor right away. Even if you don't feel like you have any type of injury, it can be subtle and just take a couple days to arise. If you don't visit a doctor right away, it can make it appear as if your injury was not actually a result of the accident at hand or that your injury was not bad enough for compensation to be necessary.
  2. Having Contact With the Other Insurance Company: Having contact with the other insurance company is never a good idea. Most likely, they will try to get you to give a recorded statement, which can be used against you. Instead, if the other insurance company wants to contact you, you should have your personal injury attorney do all the talking.
  3. Not Following Your Doctor's Orders: Anything that your doctor asks you to do should be followed through. If they ask you to make an appointment with a specialist, you should do this right away. You should also be taking any prescriptions they provide and going on bed rest if that is advised, as well. If you are not following these orders, it can, again, make it appear as if the injury is not as bad as you are claiming.
  4. Hiding Older Injuries: You should never attempt to receive compensation for older injuries through a personal injury claim if that injury has not had anything to do with the accident at hand. If you attempt to do this, you can risk your whole case being thrown out and you won't be compensated for anything at all.
  5. Not Listening to Your Attorney: The reason you hire a personal injury attorney is because they provide the best possible legal advice and will help to continue to ensure that you are not hurting your case. If you are not taking their advice, you can hurt your case further, which can lead to improper compensation.

By avoiding these five things, you can ensure that you get the most out of your claim.

About Me
Injured by a faulty floor jack

My husband does much of our auto repair work himself. We do all that we can to save a dollar when we can, and doing the repair work saves us a small fortune each year. Unfortunately, all of the money that we have saved over the past 15 years has gone to pay the medical bills that we have accumulated during the last several months after a floor jack failed and dropped our car on top of my husband. A few days after the incident, I contacted an injury attorney. I have created a blog to help others that have been injured due to faulty products find some sort of resolution.
